In Justice Abe Fortas case he argues against public speech in educational setting. Justice Abe Fortas first argument was that the “undifferentiated fear on apprehension of disturbance is not enough to overcome the right to freedom of expression (4).Fortas is saying that fear cannot take away freedom. In Fortas second argument he reveals that “the vigilant protection of constitutional freedoms is now here more vital than in the community of American schools” (13).Fortas uses the constitution to tell everyone that they have freedom of expression.
