The lawsuit concerned the fact that any exotic dancers in the state of Indiana that were designated to dance fully nude would have to wear pasties and g strings if they were to be allowed to continue to dance. The two establishments were concerned that the Indiana public indecency law went against the first amendment which they said to be protected by. They were represented in court by Patrick Baude. Baude made a statement saying that completely preventing fully nude dancers was "unconstitutionally overbroad". The district court made the decision the exotic dancers dancing was technically not "protected speech". Baude and the businesses also argued that the point of how the exotic dancers was to display "exoticism and sexuality". On June 21,1991 Chief Justice William Rehnquist came to a conclusion the dancing should be declared unconstitutional. The decision was 5-4 in favor of Barnes. The case came out with no majority
