The court case of the Bethel School District vs Fraser is a case that is fascinating. In the year 1969, Tinker, a newly popularized innovative idea surfaced. Freedom of Speech, the first amendment, was now legally applicable for people under the age of eighteen. However, this law of free speech for minors was only to be allowed if it would not cause chaos in the schools. In 1975, public schools were informed that they had to have adults approve the right of free speech for people younger than eighteen, who faced extreme disciplinary actions in school. There were multiple challenges to the Tinker decision such as what were the limits to the rule? How would this reenforce order? In other countries, this law might not be applicable however here in the United States we are able to use this to our benefit. For example, in my college people are able to advertise their talents or give out flyers expressing what they feel and think. Students publicize what they believe in, think, hear and say. It allows people to gather information informations and different perspectives, then make their own decisions, and give their decisions to the government. Most people believe that having freedom of speech improves our decision making in politics as well. Freedom of speech allows one to speak their mind, plainly because it is their mind. An interesting piece of freedom of speech in my opinion is that it does not protect abusive language. Words that are only said to destroy the reputation of the other person, harassing phone calls, and loud speech meant to create a clear disturbance are not protected. I have read about how this country struggles to make laws and rules but there is not one person that struggles over the core concept of freedom of speech.
