As a juror, I would be persuaded by Dr. Welner’s assessment because it appeared that he conducted an extensive evaluation of Brain David Mitchell. Dr. Welner interviewed 58 different witnesses and 200 sources before testifying on Mitchell’s competency to stand trial. Although Mitchell's unanticipatedly singing was abnormal, it was evident that Mitchell used to sing hymns to avoid aversive situations and demonstrate angry which was confirmed by his former jailmate. Mitchell also entered the interrogation room with his eyes closed which displays his unwillingness to participate in the interview.
