There are three branches of government and they are Legislative, Executive and Judicial. These branches were created by the leaders in 1787 to be fair and strong, also to protect individual freedom and stop government abuse of power. This separation can be found in the first three article of this United States Constitution appendix A-1 – A-7(Mallor, J. 2013 Business Law 15th Edition).The Legislative branch is made up of the senate and the house of representative and it’s most important duty is to make laws. There are 100 senators in the senate, two from each state and 435 representatives in the house of representative. The number of representatives varies from state to state depending on that state’s population.

Through court cases the judicial branch explains the meaning of the Constitution and all laws passed by congress. The head of the judicial branch is called the Supreme Court. This court consists of 18 Judges/Justices, 9 judges, 8 associate judges and 1 chief justice who are all nominated by the President and approved by the senate. They can serve as long as they want as there is no term limits. The Supreme Court is considered the highest court of the land and all decisions made here are final and cannot be over ruled by any other court.
Define Case Law:
Case Law is governed by Common Law reasoning, whereby a court will rule a case by the appropriate legal rules in a prior case. The present case will be decided in the same manner as past cases were, as long as the facts and legal issues are the same. If no applicable precedent exists then the court is free to rule how it sees fit to create a new common law rule to govern that case Mallor, J. 2013. Business Law 15th Edition page 12).
