One petitioner, Mark McBurney, was a former resident of Virginia. When McBurney’s ex-wife defaulted on the monthly child support written agreement order, he requested Virginia Division of Child Support Enforcement (VDCSE) to file a petition on his behalf for nonpayment’s. After a nine month delay the petitioner request for child support modification was permitted. Later McBurney filed a VFOIA request with the VDCSE to release information pertaining to his son and ex-wife, but the petition was denied on the ground of legal restrictions of client confidentiality and that he was not a resident of Virginia.
