Case United States vs. Mandel
Fact: Mandel exports high-tech equipment without obtaining the licenses from the government of U.S. Instead of placing the licenses number on the shipping document they put the application number, knowing that the application was returned by the government because it was adjudicated as inadequate. Despite this, the exporter sent the goods to Hong Kong.
Issue: The exporter sent controlled goods for national security reasons without the adequate licenses claiming that they had an application number.
Rule: The Secretary of Commerce can place the control on some items depending on three fundamental reasons:
