In this case, the main issue was that the defendant had been arrested without an arrest warrant. He was suspected of using mail to transport certain coupons that represented chances of winning a lottery and this was in violation of the 213 of the criminal code. The defendant was arrested by police without an arrest warrant at his place of employment in Kansas City where an express company had employed him. The express company was located at the union station during this time. In addition to this, other police officers went to his place of residency. Lacking a search warrant, a neighbor informed the officers where the defendant kept his house key. They then illegally entered the defendant's home and searched for materials
