Though it would not occur until spring of 2011, the events that would shape the upcoming trial continued. In April 2009, prosecutors changed their previous decision of imprisonment for Casey, and announced they would be seeking the death penalty (ABC News, 2011). It would now be up to the jury to decide if Casey should face death if she was convicted. In April 2010, Stan Strickland, the Judge that had been presiding over the Anthony case, stepped down amid accusations by the defense that he was showing bias against Casey (Cuevas-Nazario & Karas, 2010). At the evidentiary hearing in July 2010, the new judge ruled that Cindy’s 911 call, where she mentioned the dead body smell, would be allowed in the trial (ABC News, 2011). The jury trial would take a turn away from what many believed were the events surrounding young Caylee’s death. For instance, when the defense opened they claimed that on June 16, 2008, Caylee drowned in her grandparent’s pool and George Anthony helped his daughter cover it up (ABC News, 2011). Cindy Anthony testified she was the one who made the questionable internet searches on the family computer for “chloroform” and “neck breaking, not Casey, even though evidence showed that Cindy was at work when those searches were made (ABC News, 2011). Ultimately, it would come down to the amount of evidence against Casey in the eyes of the jury. In a decision that shocked practically everyone, the jury would find Casey “not guilty” of not only first-degree murder but of manslaughter as well.
