Client confidentiality is required to be protected from inadvertent disclosure. Agency protocols can be essential in maintaining this confidentiality. This paper details out the decision making model as outlined by the American Counselor Association Code of Ethics. Suggestions have been submitted for consideration to evaluate the potiential consequences of not following ethical responsibilities as well as ways to increase ownership in privacy and ethical responsibilities. Negative consequences that could affect the individual making the report are also explored.

In addition to a “hard” copy of the company policy, the therapist would consult the American Counseling Association, state regulations, and the rules and regulations of the state licensing board. The identified problem is ongoing disregard for the privacy and confidentiality of client records and information.
Apply the ACA Code of Ethics The American Counseling Association developed a code of ethics for counselors to understand the requirements to protect and maintain records. In 2005 the ACA outlined eight standards that address record keeping (Remley, Herlihy, 2014). The standards were created to help protect the counselor as well as the client. Records regarding any information, including phone messages and electronic media. The code of ethics provides detailed information on how to better protect confidential information. The decision making model suggests staffing the issue with colleagues. However, what would the point be if the director is not supportive of the long term change? The therapist pursuing change has to consult company policy and state rules and regulations. In Oklahoma the regulations that govern therapist actions is found in LPC Laws and Regulations (2010). The regulation refers to the Oklahoma Title 86:10-3-2.g.4 stating counselors and candidates will protect client information. It further refers to Title 59 of the Oklahoma Statutes, Section 1910. The penalty for violation of these rules and regulations can be punishable of revocation of license and fines up to $10,000
