I deposed the plaintiff on Tuesday, September 19, at his attorney’s office in Anniston, Alabama. Frank Roehler is 69 years old, married, and a native of Windsor Ontario, Canada.
He worked in the IT Department of Federal Mougl, which brought him down to their facility in Jacksonville, Alabama several years ago. After leaving federal Mougl, he started working in the automotive sales business as an internet sales representative. He currently serves as the internet sales manager for Sunny King Honda in Oxford, Alabama. He has been in three motor vehicle accidents prior to this one all in the 1970's. According to him, he was not at fault in any of those. Mr. Roehler said the weather conditions were dark and stormy on the date of loss. He had been to the store in Jacksonville and was turning south onto Alabama Highway 21, returning home. He said he was stopped at the light, it turned green, and he proceeded on to Highway 21 and saw the defendant, Timothy Foster approaching from the left out of the corner of his eye. Roehler was not taken to a hospital via ambulance, but instead visited an urgent care physician in Oxford, Alabama the next day. He claimed he was sent for X-rays and diagnosed with a broken hand, but this is slightly in conflict with the medical records we have received. Those records indicate he was initially diagnosed with a contusion, then later under went a bone scan and diagnosed with a fractured hand. Regardless the hand injury was the item of most interest to him. Mr. Roehler eventually saw his primary care doctor, Dr. L. Steven Hunt at the Kirkland Clinic in Birmingham. Dr. Hunt sent him to an orthopedic doctor, Dr. Jean Oakes. Eventually, Dr. Oakes diagnosed the plaintiff with a fracture at the base of the ________ finger
