In the case, Scott had argued that from him living in the free territories of Illinois and Wisconsin from when his enslaver John Emerson stayed in those terrorized he was to be considered free. The case made its way to the Supreme Court where it was declared that Scott was still a slave and African American were not to be considered a national citizen of the United States. It had also ruled the Missouri compromise as unconstitutional, which would support the south in its expansion of slavery. “The Dred Scott decision infuriated Republicans by rendering their goal—to prevent slavery’s spread into the territories—unconstitutional” (Corbett et al., 2014). Ultimately, the Dred Scott decision took away from previous provisions that had been made to settle conflict over the issue of the status of African Americans. South Carolina was the first state to succeed in 1850. Mississippi, Georgia, Florida, Alabama, Louisiana, and Texas, were the first of the southern states to follow South Carolina lead and create the Confederate States of America. When they succeeded they declared themselves a new nation under their own governmental authority. In their eyes, their actions were in keeping with the nature of the Constitution and the social contract theory of government that had influenced the founders of the American Republic”(Corbett et al., 2014). The Confederate Constitution would be created by them to protect the system and expansion of slavery.
