Jamie Dubinsky-Musgroves reports she was admitted to Missouri Baptist Hospital on September 9, 2014 from the Emergency Department in need on emergency surgery for an acute appendicitis and referred to Dr Levi Kirkland. Ms Dubinsky-Musgroves alleges Dr Kirkland delayed the needed surgery, conducted unnecessary and repetitive testing resulting in Ms Dubinsky-Musgroves consulting a second surgeon, Dr Guerra who agreed with the original diagnosis and did an emergency appendectomy September 13, 2014.

With a few hours she was seen by Dr. Guerra who told her the appendix had likely burst and she needed immediate emergency surgery. However, because she had eaten lunch the surgery was postponed until the following morning. She was told after surgery she suffered from an acute appendicitis with peritoneal abscess. She was discharged from the hospital September 16, 2014 and remained at home on sick leave until returning to work October 27, 2014.
Ms Dubinsky-Musgroves feels the delay in diagnosis and inaction resulted in unnecessary and repetitive testing, extended her hospital stay and recovery time, and she incurred excess cost for multiple CT scans and consultations.
On August 7, 2015 Ms Musgrove emailed a copy of a letter sent by Mitchell Botoney, Chief Medical Officer for Missouri Baptist regarding Ms Musgrove’s complaint, and a letter from Jennifer L Hardester, Attorney for Missouri Baptist Hospital (See Attachment
