A duty of care is a legal requirement that means that i must adhere to a standard of reasonable care which could affect a persons well-being. We do this by having cleaning rotas which makes sure the environment is always clean to stop the spread of infection. We also carry out daily checks to make sure that its a safe environment for the individuals.

Having duty of care means that the individuals are protected by having risk assessments these outline the risk of the activities we do in work place and rate the chance of this happening. This reduces the chance of harm and we also have policies and procedures that give you clear rules and boundaries ensures that staff know how to act within the work environment, this means not behaving in ways that could cause distress or harm to individuals.

2.1 describe potential conflicts or dilemmas that may arise between duty of care and an individuals rights ?
Potential dilemmas could be that sometimes individuals may want to do something which could be a risk to their Health and safety and duty of care means that you must do all that you can to keep them safe but you also have a duty to respect the individuals rights and choice.
Also if you stop an individual from preparing food or drink due to it not being safe then you’re taking away some of the individuals independance.
If an individual and the individuals family want them to do an activity but you think its not safe then there will be a conflict between staff and the individuals family.
2.2 Describe how to manage risks associated with conflicts or dilemmas between an individual’s rights and the duty of care
If the dilemma is your duty of care clashes with the right of an individual by taking away some of their Independence then you find ways to promote their Independence in other ways, for example if they are shouldn’t use a kettle to make a cup of tea and you stop them then you’re taking away some of their independance but if you ask them to prepare the cup of tea then they gain it back.
Also if an individual wants to do an prepare food or drink but you don’t think its safe and then you should explain to them why they couldn’t do it but you must remember that some risk is okay.
If an individual wants to do a new activity but you don’t now if its safe then you’d write a risk assessment for it outlining the risk and the likelihood of this risk happening.
