Dzhokhar Tsarnaev is a United States citizen who faced trials in Massachusetts due to the April twenty thirteen Boston Marathon bombing. The Attorney argued that Dzhokhar is seeking final punishment particularly heinous and depraved manner. Eric holder said that the jury selection can’t serve on the jury if they have moral opposition to the death penalty. Furthermore, although Boston area residents were too biased to serve on Tsarnaev’s jury, a majority were against death penalty if the defendant was convicted. It was very likely that Tsarnaev had faced great torture. That is because for more than a year after the bombing tragedy he was kept in solitary confinement. Dzhokhar had no access of television, radio, internet or any other social media. He was just allowed one letter and one phone call a week and that was an indication of proper torture as there was possibility of trauma and even permanent damage caused by long period of isolation. Treatment of Tsarnaev could say more about humanity rather than guilt. Death sentence could not solve anything but just to fulfill the defendant wish to be martyred as he expressed before his arrest. The theory tell us that man is a calculating animal in the causes of criminal behavior (Ferri, 2014).That helps us to understand reason why defendant committed crime because we are told that Tsarnaev wished to be martyred before the arrested and seek ultimate punishment particularly heinous and depraved manner. That vividly indicate that he had measured the consequences of his intention and knew the crime shall lead to death sentence.
