Imagine you’re in class, you raise your hand to go to the bathroom, your teacher says “yes.” As you walk down the hall towards the boys bathroom you are stopped by a teacher, who tells you you cannot use that bathroom, because you’re “technically not a male.” In 2014, this imagination was a reality for Gavin Grimm, 13 years old, who at the time was transitioning from female to male. After Grimm was told no to something so simple and regular to an everyday school life, he sued his school, Gloucester Country School. Surprisingly, the roots of this case lie over two hundred years ago, in the Fourteenth Amendment to the U.S. Constitution. “All persons born or naturalized in the United States and subject to the jury. There are many loop holes to Grimm’s case, that tie with the 14th Amendment which is the main witholder of the argument. July 28, 1868, The fourteenth Amendment was ratified. The Amendment was used for many different causes in the middle to late 1800’s. For example, women used the Amendment to help their right to vote, African Americans used it for their rights as citizens as well. The supreme court ruled the case of Plessy vs. Ferguson (1896), that stated “seperate but equal” was supposed to apply to the 14th amendment. Homer Adolph Plessy V. was born seven-eigths caucasian, one-eight African American. Although he was “majority” of white decent , by Louisiana Law, Plessy was classifed as “black.” On June 7, 1892, Plessy bought a first class train ticket that was headed towards Covington, New orleans. Earlier before the boarding of the train, the railroad company was informed of Plessy’s classification of, African American. The company took it into their own hands and hired a secret agent to investigate Plessy and take charge. During the train ride Plessy was told to sit in a black car, and refused.
