The were some severe death penalties in the code of Hammurabi. If the thief cannot pay, he shall be put to death. I think they were so severe so that he can keep the people he controlled in order and unify them as well. In order to do that he had to set some laws down. He also wanted justice in his kingdom, in order to have that he had to destroy the wicked people and evil-doers, and hoping the wealthy(the strong) won't hurt the poor(the weak). I think the laws were unfair to the society because in Law 23 it says that “if the robber is not caught, the man who has been robbed shall formally declare whatever he has lost before a god, and the city and the mayor in whose territory or district the robbery has been committed shall replace them whatever he has lost”. This is unfair because they did not do the crime, why do they have to pay for it. The laws were also unfair to the ones that are harmless victims, in Law 48 it says ““If a man has borrowed money to plant his fields and storm has flooded his field or carried away the crop,…in that year he does not have to pay his creditor.” This is unfair to the creditor because the creditor never get his money. Law 7, “ if a man strikes a free born woman so that she loses her unborn child, he shall pay ten shekels for her loss.” He should have been thrown in jail or death because what is money going to do for her loss.
