QUESTION
In your view is it ever justifiable to place the burden of proof on the defendant? Give reasons for your answer.

Your answer should be in the form of an essay of no more than 2,000 words and submitted in hard copy through the Student Office and electronically through TURNITIN before 4pm on Monday 3 September 2012 . A failure to submit in both methods will result in a grade of 0%.

The essay will be assessed according to the following criteria:

1. Inclusion of a clear introduction which summarises the argument, sets out how the candidate is going to approach the question.

2. The body of the presentation develops a critical rather than a narrative account and demonstrates both an understanding of the relevant concepts and a sound knowledge of general principles of Evidence law.

3. There must be discussion of suitable authority and sources. This should include both relevant and recent case law and statute and a critical discussion of at least TWO other appropriate and relevant scholarly texts.

4. The essay should come to a reasoned conclusion which summarises the argument and demonstrates individual insight. The essay should have a well-developed structure, include a bibliography in the correct form and the referencing should be scholarly. Overall the use of English
