Richard and Mildred Loving were charged by the Caroline County Circuit Court for violating of Virginia’s ban on interracial marriages. They were found guilty and sentenced to one year in prison. The judge suspended the sentence on the condition that the Lovings would leave Virginia for 25 years.
The Lovings filed a motion to vacate their sentences with the State Trial Court because they believed the Virginia miscegenation statutes violated the 14th Amendment.
