Before the time beings I would like to take a moment to introduce myself and my team. I am Max Rosedale, and my co-counsel is Matt Ripple . We are representing the plaintiff in today’s case. We will be calling two witnesses AJ Bryant played by Liza Boyd and Justice Smith played by Alex Sweeney.
May it please the court, this case today is all a matter of brains vs brawns. Proper application of this idea would have prevented the shooting of an innocent young girl. The defense has the burden of proof today which is preponderance of the evidence. Today the defence will “attempt” to prove that Officer Riley Green justified the use of deadly force under the 4th Amendment prohibition against unreasonable searches and seizures and that officer Green was justified in using deadly force. We the plaintiff will show you today that Officer Green did not act within the scope of the three tests of Garner not permitting him to use deadly force which is a violation the the 4th Amendment. Today we will show the court that this is all about Brain vs Brawn. We will show you that the prevention of an innocent person being shot would have been possible if Officer Green just used his brain and his training instead of using his Brawn instantly shooting.
Indisputable facts that neither side can disagree with is that AJ Bryant was carrying a toy bow when this incident occurred and Officer Riley Green used deadly force on AJ Bryant while he was carrying this toy
