As we know from Mike Rudy’s testimony, we know that there have been several near accident at this intersection recently, so Max Paulson should have known this, and he should have been more careful. Also, Max Paulson had made no attempt to slow down before hitting Sam Smith, so Sam was thrown across the street. Max is guilty of careless driving, because according to Minnesota Statute 169.13, Subdivision 2, anyone who drives “in a manner that endangers or is likely to endanger any property or any person… is guilty of misdemeanor.” Therefore Max is guilty, because he did endanger Sam Smith.
Also, according to Max Paulson’s testimony, the intersection was busy and there wasn’t a very large gap in traffic, so he should have waited for a larger gap
