The objective of the “necessary and proper” clause is to give Congress the power to make decisions or laws that are necessary for them to carry out their enumerated powers. 5. Justice Marshall justified ruling that the dartmouth charter was contract because even if charters of nonprofit entities were considered by the framers, the language used in the constitution would not be any different and since nothing in the constitution that would justify a state interfering with a contract, the contract was considered valid and the court ruled in favor of the college.
The dartmouth case is considered to be important in the economic history of the US because it gave protection and legal stability to businesses, which encouraged small businesses, investments, manufacturing and commerce.
If Dartmouth was a private college, the state of New Hampshire could not tax it. Dartmouth also heavily supported federalists, while the state legislature was controlled by republicans. The establishment of state universities served as source of income for the states, as well as political support.
