Writing Assignment #2 Mens rea is used to constitute parts of a crime. This helps determine the action or conduct of the person who has been accused. In this case Maria has been given a compromise of transporting a car through the border for $1,000. The detail the person left out when advising and informing Maria is that the secret compartment had cocaine stashed in the car. In any type of case like this the victim always tries to argue they were unaware of certain circumstances. Sometimes it may be true but many times it’s false; she was aware of a secret compartment but did not question what was inside. Mexico is known for its huge drug cartel and drug trafficking. Maria for a fact is well aware of this and should’ve used her common sense to question why the car even had a secret compartment. The woman was in position of the car at the time, laws clearly state if you are in position of it you will be charged either way if you claim it is not yours. Words do not define innocence, actions and evidence do. Now that she is in custody and is being charged the story is changing. A deal can be worked out if Maria feels as if she is innocent and was actually unaware. She may get a lawyer work out a deal with the judge and see if she can do 4-6 years in prison and 3 years on probation if she give out names and information on the person who asked her to drive the car to the United States. Unfortunately, the evidence does show otherwise for Maria it’s her word against the evidence. Most likely Maria will refuse to do this deal due to he safety concerns and her revealing a drug dealer or even a drug lord that can lead her or her loved ones to be in
