Mr. Montano’s interview was assisted with the certified Spanish transit who translated Mr. Montano’s statements from Spanish to English. He said he has been with the company TJ Co. LLC for about six years. Mr. Montano said he oversees the warehouse and manages the warehouse alone and does not work with any other departments within the company.

Mr. Montano claimed that he knew very little about the claimant Mr. Lopez. He said Mr. Lopez then when he worked in the sewing department working area that was separate from the warehouse. Montano describes the claimant, Mr. Lopez is a short and chubby male Hispanic who stood at 5 feet tall. He had dark brown skin and did not wear any prescription eyewear. He did not have any further details to the claimant’s identity, marital status, children, medical family history, pre-existing medical conditions, congenital disabilities or physical abnormalities, and personal life.

He recalled that the claimant was let go by the insured about two months ago. He was not sure about why the claimant’s position with the company was no longer needed as he believed that the claimant might have found a job elsewhere. He did recall that the claimant Mr. Lopez, work Monday through Friday from 7:00 AM to 3:30 PM, as he would have Saturdays Sundays off. He recalled the claimant had his regular two fifteen-minute breaks and a 30-minute lunch break. He said that the claimant at the same lunch breaks as everyone else did who were full-time employees.

Regarding the alleged CT claim, which the claimant and his attorneys are now alleging; Mr. Lopez was confronted about this issue and was asked whether if he had saw any incidents involving the claimant that required the claimant to be medically treated or medically evaluated for any injuries or illnesses.
