The preliminary hearing
The preliminary hearing went on smoothly and albeit an unprepared defense Attorney the proceedings followed proper procedure and the judge ruled according to the requirement of the judicial process. All the witnesses pointed out towards the two boys, and the sheriff who had caught the boys by surprise claimed that they had made a confession (Lynn, 1992). A confession is however recorded or signed to prove its existence. The sheriff did not provide these documents or forms of evidence to the court. Vinny, who was the defense attorney, should have done more to ensure that the case did not go to trial but didn’t although all the evidence presented was circumstantial. The judge, however, set the trial date when these parties were expected to report back to court and make their case.
Arraignment…show more content… In response to arraignment, the accused is expected to enter a plea. In the movie My Cousin Vinny, Vinny made a mistake during the arraignment. Instead of pleading guilty or not guilty, Vinny started to explain the situation. This was supposed to happen during the trial. However, this was not his fault because it was his first court trial. Furthermore, after an argument with the judge, Vinny finally pleaded not guilty.
Verdict
A verdict is a decision on a disputed issue in a civil or criminal case or an inquest. In My Cousin Vinny, up until the point where Vinny suddenly steps up his game, the verdict is guilty. The prosecutors proved the defendants guilty by paying the witnesses to go against the defendants. However, Gambini found an error in their proof and therefore proved the defendants not-guilty. Therefore, in the beginning of the trials, the judge returned a verdict of guilty, and by the end, he realized they’re in fact not-guilty.
