Unit 2 Research Essay Neil Gorsuch was sworn in as a Supreme Court Justice on April 10, 2017. Since then, he has ruled on a variety of cases such as the California gun law, LGBT rights, Trump’s travel ban, and use of taxpayer money for Religious schools. His rulings have fallen on the conservative side. A good Justice has integrity, is educated, has experience, and is virtuous. Neil Gorsuch may display those qualities of a suitable Justice, but his rulings are biased from his beliefs. A Justice should plainly interpret the law, not add their own point of view. The audience of his educational background is important because it validates the authenticity of the information. All the schools he attended are highly respected institutions. Gorsuch received his Ph.D. by writing a dissertation titled The right to receive assistance in suicide and euthanasia, with particular reference to the law of the United States. The dissertation is meant for the examiners reviewing his work so he could earn his doctorate. The audience is important because it is one of the reasons why the dissertation would be one of his best works on the study of the law and displays his academic success. In the essay, he debates whether assisted suicide and euthanasia should be legal. He touches upon topics of the history of assistance in suicide and euthanasia, why assistance in suicide and euthanasia is practiced, and the principles guiding assistance in suicide and euthanasia in common practice. In his short time in the Supreme Court, he has exclusively voted on the conservative side. The law can be interpreted in different ways, but it should not always align with one’s views. The importance of this document is his biased viewings of the law. A Judge should be unbiased, but his rulings on cases are showing that he is biased. One example of his biased rulings is on the funding of religious schools. The case was on whether or not the government should fund religious schools. If the government does fund religious schools, it would make citizens think the government is favoring one religion over another. The final verdict was the government will fund religious schools if it will only be for things like repairing playgrounds. However, Gorsuch voted against only funding religious schools for repairing playgrounds, rather voting for funding them for more than just playgrounds. He voted on the grounds of “religious schools are entitled to the same kind of taxpayer funding that other schools get.” However, in the Bill of Rights, in the first Amendment, it states there is freedom of religion. The government cannot favor one religion over another. Gorsuch’s conservative values can have an affect on his rulings on cases. On the flip side, Gorsuch can agree with liberals on the law.
