Presumption has been made that ‘a woman would not get down into the treatment tanks to check gauge readings’ (quoted from the case). Also it was found from the case that Ovania chemicals had the history of employment discrimination charges. Firstly, a few of the selection committee member has serious doubts on whether ‘women or minority in the relevant labor market would have requisite credentials to be competitive for the position’ (quoted from the case). Secondly, ‘Word through the grapevine was that many did not consider a woman or minority suitable for such a prestigious position’ (quoted from the case).On the contrary, is also mentioned in the case that, Management committee has decided to make the selection process of the candidate fair and objective which is why unnecessary prescreening of applicant qualifications, previous experience, and so on were to be avoided, to encourage minorities and women to apply for the position. As per selection Legislation of any company, by law, Ovania Chemicals have to mention the task regarding the physical activity in the job description under task and duties to be performed. Moreover, dirty treatment tank of any chemical company can be considered as an ‘Inhuman trait’ which is equally hazardous for both the gender.
