A criminal offence is a harmful act not only to a minority of people but can also include whole communities and is seen as forbidden. This type of act can also be punishable by law. For example theft, robbery and murder etc.
The role of the criminal court hierarchy (magistrates & crown court)
In the Magistrates court many cases are completed there, as well as civil cases. This brings order and peace to the community. This type of court deals with summary offences, Such as: speeding, littering etc. In this type of court it usually consists of 3 judges whom are supported by a legally qualified court clerk. There would be no juries as the judge would be independent of them. But in certain circumstances there is a right to a civil jury. These circumstances are: malicious prosecution, false imprisonment and fraud. There may be a lawyer present and can offer legal advice to the client. Due to the hierarchy a magistrate may take the place of the judge. The magistrate judge sits 26 half-days a year and works with criminal cases but does have civil jurisdiction. In cities they may use a district judge. Furthermore the punishment when compared to a criminal case is less severe and can consist of fines or services. The role of the judge is to make the decision and also to server the punishment. This is because there is no jury. A lawyer is normally based in an office and gives advice to the client. Another role of the lawyer is to present the evidence to the judge. They usually have a university degree but not a law degree. A majority of solicitor firms do employ legal executives who work on the foundation (basic) tasks and they are working for the solicitors. The solicitors may work on their own but more often work with other solicitor firms. Most solicitor work include: conveyancing- dealing with the legal requirements of bullying and selling property and probate – drafting wills and acting as executors for the estates of deceased persons. The lawyer may present evidence such as Amal Ali being unsatisfied or distressed for the services they received. Furthermore Amal Ali’s family did not enjoy the holiday as “their package holiday did not match what was promised by the tour operator”. In my opinion this is false advertising and the company should compensate for the expenses as a result of this.
