Pc 606 Case Study

INTRODUCTION:
This case involves the suspect being arrested for PC 602(o)-Trespassing, PC 647(e)-Illegal Lodging, PMC 3.24.110A-Illegal burning and outstanding warrants. The suspect was also found in possession of a controlled substance in violation of H&S 11377(a).
LOCATION DESCRIPTION:
This incident occurred in the City of Pasadena dirt lot located at the rear of the Community Home Care of Pasadena Urgent Care (3160 E. Del Mar Boulevard).

EVIDENCE:

• Plastic baggie containing a white crystal substance inside, which resembled Crystal methamphetamine.

INVESTIGATION:

Officer Jones and I contacted a male Hispanic, later identified as Lucas Adruval Amaya, who was standing near a tent located on city property.
Officer Jones ordered Amaya away from the tent. Amaya complied with Officer Jones orders without incident. Officer Jones handcuffed and arrested Amaya for PC 602(o)-Trespassing and PC 647(e)-Illegal lodging. The handcuffs were double locked.
Amaya admitted to having property at the above location which belonged to him. I also observed that Amaya had a small pan near the tent, which was cover with a pan lid. I removed the pan lid, which was hot to the touch and saw wood burning inside of it in violation of PMC 3.24.110A-Illegal Burning.
I began to walk Amaya to my patrol unit (#52) and he spontaneously admitted to having crystal methamphetamine in his possession. Amaya stated he uses crystal methamphetamine because he is schizophrenic. Amaya reportedly snorts the crystal methamphetamine approximately twice a day. I opened the plastic baggie which contained a crystal substance. Based on my training and experience, I recognized the substance to be crystal methamphetamine. Amaya was not under the influence of a controlled substance. Amaya also had marijuana in his possession.
Officer Jones conducted a records check on Amaya through Pasadena Dispatch. The records check revealed two outstanding warrants for Amaya’s arrest (see attached printouts).
I took several photos of the area where Amaya was found trespassing, illegal lodging and illegal burning (see attached photos). I advised Amaya that he was trespassing on City Property and could not return. Amaya stated that he understood and would not return to the above location.
I advised Sergeant Villalovos #9034 of the above incident and he approved the arrest. I then transported Amaya to the Pasadena Jail for booking. I issued Amaya a citation for PC 602(o)-Trespassing, PC 647(e)-Illegal Lodging, PMC 3.24.110A-Illegal Burning and H&S 11377(a)-Possession of a Controlled Substance (Citation #C435913). Amaya is scheduled to appear at the Pasadena Court on 05-07-18 at 0830
