If I had clocked her on radar and pulled her over, I would have informed her the reason she was pulled over.Then I would proceed to tell her that there had been complaints of speeders in this area. I would ask her about the gas pedal getting stuck and be sure this was not a hazard while driving her vehicle. If I felt like this was a hazard to public safety, For this reason, I would have the vehicle towed and cite her for speeding.

If the gas pedal incident did not seem to be an ongoing problem, When her license comes back clean, and she provided her insurance and registration, In this case, I would release her with a warning.

Not all traffic stops warrant a ticket, especially when the offender has never committed any other offense.It is important to realize police officer is usually the first contact with the offender, at that time they have to make a decision on how to handle the situation. In fact, the situation could be as simple as a warning, a ticket, or use of deadly force. In that moment discretion is used on how to proceed, it is a split second decision. The more serious crimes the less discretion the police officer has. In fact, if the officer cited each infraction, there would be so much paper work on the officer, it would limit their time patrolling. Essentially, it would also bog down the court system with these smaller crimes. (Dempsey, J. & Forst, (2016).

In fact, their training begins in the police academy and should continue while on the job. Discretion will always be a part of the police officers job. Every stop and every situation can be different, very few would be text book examples of how to handle the offender. (Dempsey, J. & Forst, (2016).
