Plea-bargaining is an arrangement between the defendant and the prosecutor in where the defendant pleads guilty in order for them to get charged with a lesser sentence. Plea-bargaining has both advantages and disadvantages. An advantage is that the defendant can reduced the sentence, and length of the trial. A disadvantage is that allows for serious convicted delinquent to receive a lighter sentence. In the case of Shantel, Shantel has to decide whether to take the plea and get a shorter sentence and keep her daughter, or plea not guilty and go on a extended trial and possibly lose her daughter. The defendant has to make a smart decision whether he/she will take the plea-deal.
Plea-bargaining is extremely important element of the judicial system. Without plea-bargaining, the judicial system will slow down and have a lot of defendant waiting for trial. My client has managed to stop the use of crack. She also has a secure job and manages to care for her daughter. She has put her life back on track. She was living alone with her daughter for the past two years until she decided to move back in with her ex-boyfriend. My client was unaware of Deshaun’s abuse for OxyContin and the hidden stash of drug. If my client was aware of Deshaun’s addiction to OxyContin, I believe that she would of have not moved in with him in the first place. Another reason I would advise my client not to receive the plea-bargaining because according to the Fifth Amendment, a person cannot be charged for the same crime twice in the same jurisdiction.
