R. V. Killam Case Study

On Wednesday March 14th, 2018 I attended the Ontario Court Of Appeal at 444 Yonge Street. The case I was able to sit in on and review was R. v. Killam for the criminal offences of impaired operation by alcohol and operation over 80mg. Presiding Judge Madam Justice Rebecca Jane Rutherford held this case in courtroom number 510 for trial continuation, but more specifically to further evidence. This incident occurred on November 22nd, 2016 at around 12:53am involving the crash of a white pick up truck into the side of a Canada Trust Bank at the intersection of Church Street and Wellington Street East in downtown Toronto. Officer Ladurante continued by stating how he had to help Jamie out of the driver side, due to the damage on the passenger side door. The crown began to ask officer Ladurante what he did next with Kandyse after Jamie was brought into the back of the ambulance for minor injury treatment. Officer Ladurante said he then brought Kandyse in the back of his scout car “to keep her warm” and ask questions at 1:11am. When officer Ladurante put Kandyse in the back of the scout car, he said he “smelt a faint whiff of alcohol”. For which he then head to run to the damaged truck to look for where Kandyse thinks her asthma inhaler is because she thinks is having and anxiety attack, but he cant find it. The crown then asked what else is saw in the car. Officer Ladurante then states he found “two empty beer cans”. At 1:16am she is read and informed of her rights and what she is being charged for.
