The seven elements of a crime help distinguish, categorize, justify, and confirm criminal offenses that have been deemed as such. These elements are punishment, concurrence, causation, harm, legality, actus reus, and mens rea. There are several questions that need some answers in relevance to whether illegal drug use, prostitution, and gambling are aligned with these seven elements (Bethel University, 2013).
Illegal drug use such as marijuana does not fit the seven elements of crime. Marijuana is illegal by law so it is legality for sure. The fact that people choose to consume marijuana places it in a category that is not harmful unless another circumstance is present. Now, if someone plans to arrange a drug deal and kill their business partner and take the drugs and the money, then the seven elements would apply in my opinion because all the traits are there for this type of crime (Quizlet, 2015). The intent and act are present, it is harmful behavior and punishment is defined by the law and must be applied. Therefore, this would be categorized as a mala in se type of crime. This is wrong and violent drug deals occur everywhere.

What is prostitution? Prostitution is a form of sexual exploitation in exchange for money, drugs, or material goods (womenslaw.org, 2012). Prostitution should be in the mala prohibita class because it is not a severe crime. If a prostitute is raped, assaulted, or violated in any way they can report these crimes because they are victims under these circumstances. The act itself cannot be in the harm group because this is not bringing harm to your body and there is no violent intent to do any harm or commit murder. And gambling is the same as prostitution in my
