One of the questions when discussing social security is when will there be reform because it has been running at a deficit sense 2010 (Boccia,Patterson). Reform has been talked about from both the democratic party and the republican party sense 1982 when the government borrowed $600 million to pay benefits on time (Bryant, Delea, and Burrell 51-59). We always here about it during the election cycles candidates are always proposing plans for reform, but none of them ever follow through with what they say. That’s right you and who pays for social security? Right again you and that’s why you should care whether social security is at a deficit or not because sooner or later it may catch up to you. One of the things that I used to think about social security is that we are entitled to it because we pay into it every time we get a pay check. I mean its and entitlement program isn’t it! But my preconceived notion of social security being a right was wrong. It was stopped dead in the water once I found a supreme court ruling from 1960 Flemming V. Nestor. In this case the subject of the case was whether social security was a right/entitlement to benefits from social security to the people paying into it. The reason it was brought up to the supreme court was because Nestors benefits were stripped from him once he was deported and he claimed that it was unconstitutional for the government to also strip him of his right to social security because his wife was able to remain in the United States, but she would also be stripped of his social security benefits (OCOMMOPUM). All though Nestor won the case and got the decision reversed the court ruled that Social security benefits is not a contractual right (OCOMMOPUM). The original social security act granted the permission to congress to make any provisions to social security.
