Proximate cause evaluates when the negligent party is no longer responsible for the consequences of their actions. It’s the relationship between an event and an injury. At what point is Steve no longer liable for his actions? Before he made the attempt to climb the tower, Steve was aware that is was raining and he knew he had been drinking. In my opinion, he was liable up until that point. One Steve got electrocuted by the hanging wire, the fault is now of MSTC. They had the duty of keeping the maintenance up on the tower. The fact that they were aware of pigeons being fried due to their negligence, demonstrates that they were full aware of the dangers of climbing the water
