In this opinion paper, I will discuss and describe my decision for United States v. Fields. This case relates to the Stolen Valor Act, and how the legislation contradicts the freedom of speech. In brief, Abel Fields made a false claim that he had received a purple heart during his service with the military. It was however revealed that Fields had never served in the military and could, therefore, not have received the military decoration.
The Stolen Valor Act came into effect in 2006 and made it a crime for anyone to make a false claim that they have received military awards. Abel Fields was sentenced and fined based on the Stolen Valor Act by a lower court. He, however, believed that he should not have been convicted
