Rape and the Culture of the Courtroom explores the idea that the adversary system here in the United States reflects male expectations about justice and gender. Andrew Taslitz examines how cultural narratives shape trial outcomes, analyzes aspects of rape trials that have historically put women at a disadvantage when they are the victims, and finishes with historical commentary showing the reader how the reform suggested by Taslitz fits into the history of rape law reform. Taslitz does a fantastic job of showing his readers the cause of rape reform failure in the language that the lawyers are using and the cultural narratives they use to dominate the victim’s side in the courtroom.
