Contract #1: Sarah vs “Kidz Go Bananaz”
According to the facts, we can say that there were 6 different potential contracts. The first potential contract was between Sarah and “Kidz Go Bananaz”. When she called asking them for the availability, the employee said Sure, we will there Sunday morning to set up (offer) she asked for the price and even when the said “you will know the price on Sunday evening (after the party finished) she said, “I accept” (Acceptance). Then they have a contract, based on a set or commitments or promises. Because at the end of the party Sarah wasn’t happy with the price they can decide what is a fair and reasonable price (adequacy of Consideration). She can refuse to pay and say in her defense that wasn’t a formal contract, because during the offer they never gave her the price (one of the conditions to make a contract forceable).
