Facts: On an October evening in 1974, Memphis cops reacted to a theft call. One of the officers went to the back of the house and saw an escaping suspect — 15-year-old Edward Garner. The casualty began to escape the scene of the claimed robbery. An officer saw the victim, and could see that victim had no weapon, and hollered at him to stop. Casualty kept on climbing the divider to escape and soon thereafter he was shot. Casualty's dad brought the matter for an infringement of the victim’s rights. The judge found the officer's activities were sacred. The Appellate Court switched and the State offered.
