Discrimination on the basis of one’s sexual orientation isn’t included as a protected class in Title VII. The reason this chapter is included is because 22 state laws and Washington DC have state laws that ban workplace discrimination on sexual orientation and gender identity. There are local ordinances, and thousands of workplaces that include discrimination against LGBT as discrimination.
