Based on the analysis of the Tinker v. Des Moines case and the arguments of those who believe certain kinds of speech should be prohibited within an educational setting and those who believe the opposite. The argument that Fortas presented was the stronger argument out of the two because he gives younger people that are in school the same rights as people out of school.
