In this case a patient fell while getting an x-ray taken. In the lawsuit the patient claimed that those techs acted negligently, because they “knew” she had the tendency to become dizzy. The patient had proved that had a tendency to become dizzy, but evidence showed that the physician’s examination request had no evidence of her becoming dizzy.
This case would have definitely turned out differently if the radiologist or technologist had noticed the patient walking unsteadily before the x-ray, even if no notations were made on the examination request. If someone saw that the patient walking unsteadily they would have known she could not stand alone for the x-ray. Someone would have gowned up in lead to go help that patient stand or would have
