While en-route, dispatch advised all units that a black, Chrysler PT cruiser was parked in row #2 with the engine running. Furthermore, the vehicle's headlights were on along with it's windshield wipers. The driver also appeared to be "passed out." The caller/ complainant was Walmart Assistant Manager, Jaime Robles.
Upon arrival, Officer Hartmann and I pulled approximately 10-20 feet behind the vehicle. Neither of our patrol vehicles had their lights or sirens activated. Dispatch advised that the vehicle belonged to a White male subject by the name of, John King. I next looked through the driver's side (untinted) window and I observed a White male laying back in his seat. Due to a possible medical emergency, I knocked on the window and the subject awoke suddenly and opened his driver's side door. I asked the subject if he was ok and he advised he was. The subject further stated that he was tired and "just sleeping." The subject had watery, bloodshot eyes and slurred speech. The subject then requested to exit the vehicle and he did so.
Dispatch conducted a wants and warrants check on the subject with positive results. The subject had a valid DL, and he was currently on felony probation for battery until 08-31-2019. The conditions of his probation were no alcoholic beverages or illegal drugs.
The subject advised that he was currently homeless and had nowhere else to go. When asked, at first the subject denied consuming and alcoholic beverages or illegal drugs. However, he later admitted to "smoking pot." Verbal consent to search the subject's vehicle was granted by him at approximately 02:07
