Faden’s video is considered fair use. Fair use is a term we use in court when convicted of copyright infringement. Copyright infringement is taking someone else’s copyrighted work, without permission and calling it ours. Copyright is put like a barrier on someones original work that does not allow others to use it without you giving them the right to do so. Faden did not say this the movies where his own work, he did not take Disney’s ideas, he just used a small amount of someone’s work to make his own original work. And as we all know, fair use is determined by four different factors, the purpose, the nature of the original work, the amount used, and the market harm the new work has to the original. Faden should have not been convicted of copyright infringement for his work is fair use. His work fall under two of the requirements to be seen as fair use. …show more content…
It states that if someone uses copyrighted material for a certain purpose, let’s say for educational reasons, then it is indeed considered fair use. The video made by Faden titles “Fair(y) Use Tale” was used in a way to show other people what and how copyright works and the limitations it has to it. He is a professor and has made this video using Disney to show that even if Disney is very strict on their copyrighted work, there is still a way to use it without it being copyright infringement. The sole purpose was not to make Disney look bad, to help people understand the copyright laws with our favorite childhood
