It’s Christmas day and your family is gathered at the fireplace, getting ready to open your Christmas presents. When you open your present, you find a limited edition plushie, however it looks like it got a bite taken out of it. In a different part of the world, an elf is starving to death with very little pay, not being able to feed itself and its family. Elves should be paid minimum wage for the elves’ well being, a violation of the elves’ rights, and a violation of law.

According to “Minimum Wage Violations: What Employees Need to Know in California” by The Myers Law Group (MLG), it is a violation of rights to; “Paying you less than the minimum wage rate, paying you for fewer hours than you worked, not paying you for all the work you did, including overtime, taking illegal deductions from your paycheck”. Although this is a violation of rights in California, Saint Nicholas (Santa Claus) has flown over California a plentiful amount of times, delivering gifts to children like me which means that he technically has to be a citizen of the U.S. which makes him violate the elves’ rights. According to the Department of Industrial Relations’ website, “For each subsequent violation or any willful or intentional violation the penalty is two hundred dollars ($200) for each failure to pay each employee, plus 25% of the amount of wages unlawfully withheld”. If Santa Claus were to not be paying his workers the minimum wage, and (estimated) he had 20 million workers, he would have to pay over 2 billion dollars in fees for a violation of fundamental rights, as it is a form of exploitation. Santa Claus would be most likely in debt for a very long time due to probably not having over 2 billion dollars to pay to the government, which is why elves should be paid minimum
