In the case of Baker vs. Silver Oak Senior Living Management Company, I would find in favor of the plaintiff, Ms. Baker. The Silver Oak Senior Living Management Company did discriminate against her on multiple occasions. The dictionary defines discrimination as the unjust or prejudicial treatment of different categories of people of things (Merriam-Webster, 2012). There are protected classes in Employment Laws. These include: age, disability, ethnic/national origin, color, race, religion, sex, veterans, and immigrations. Employers need to have a clear understanding of employment laws to prevent discrimination and unethical behavior. The first area of discrimination falls under Age Discrimination. One of the protected classes is anyone forty years of age or older. Ms. Baker, who was fifty-three-year-old, was targeted by the Management Company because of her age. Baker was harassed while she was employed with this Management Company. When top managers made statements about hiring younger people and made false accusations against Ms. Baker, these are forms of harassment. Other forms of harassment include: social isolation, silent treatment, rumors, threats, ridicule, name calling, excessive criticism, monitoring work, withholding information or depriving responsibility and physical or verbal aggression (Lockwood, & Marda, 2014). Any form of harassment creates a toxic work environment. It is Human Resource’s responsibility to come up with a way for an effective response to harassment allegations. When someone is being harassed, they experience psychological and work-related hare. These include: decreased work performance, absenteeism, career interruptions, decreased job satisfaction, depression, and other health related problems (Lockwood, & Marda, 2014). If her medical leave was caused by The Management Company’s harassment, Ms. Baker may be deserving of a cash
