Burning the American flag is said to be protected by the first amendment. Burning the flag is seen as freedom of speech and protest. The very act of burn the American flag in protest is a hate crime and the very opposite of what the flag stands for. The decision that flag burning is constitutional was decided by the Supreme Court during the Texas VS. Johnson case in 1989. This decision was wildly controversial to this day could be overturned by the Supreme Court in a revote.
