In the case of Graham v. Connor, the petitioner (Graham) decided to seek compensation for the injuries sustained during a routine stop by the respondent (Connor). Before the arrest Graham had an insulin reaction and asked his friend Berry to take him to a convenience store, so he could buy orange juice to counteract his affiliation. As he entered the store he noticed that the line was too long, he immediately turned around and hurried back out of the store to ask Berry to drive him to a friend’s house instead. Connor, an officer of the Charlotte, North Carolina, police department watched as Graham entered and exited the store hastily, suspicious of Grahams actions, Connor followed Berry’s car. Once Connor received the report that Graham had done nothing wrong, the officers drove him home and released him from custody. During his altercation with the police Graham had suffered a broken foot, a bruised forehead, an injured shoulder, and cuts on his wrists. Graham the filled suit against the officers, saying that they used excessive force, in violation of “rights secured to him under the Fourteenth Amendment to the United States Constitution.” When brought before a jury, the respondents asked for a directed verdict, the District Court decided the case on four factors. “(1) the need for the application of force; (2) the relationship between the need and the amount of force that was used; (3) the extent of injury inflicted; and (4) whether the force was applied in a good faith effort to maintain and restore discipline or Page
