I observed the vehicle fail to signal while turning East on West 81st Street and accelerate at a high rate of speed. Upon approaching the vehicle, I smelled a strong odor of marijuana coming from the vehicle. I asked HOLMES where the marijuana smell was coming from within the vehicle. HOLMES stated he did not know. After providing me with his driver's license, I asked HOLMES again why I smelled marijuana coming from his vehicle. HOLMES stated he was at Pretty Water Lake smoking marijuana on his lunch break. I asked HOLMES how much marijuana he had smoked. HOLMES stated about half a joint. I asked HOLMES how long it had been since he smoked marijuana and he stated approximately 30 minutes. I asked HOLMES if he had any marijuana in the vehicle. HOLMES stated he did not, that he smoked all the marijuana. I asked HOLMES to step out of his vehicle and stand at the back. I advised HOLMES that I was going to perform a probable cause search of his vehicle. I again asked HOLMES if there was marijuana in the vehicle. HOLMES stated there was marijuana in the front seat. I asked HOLMES to retrieve the marijuana. HOLMES handed me a Miracle-Gro box that he retrieved from the floor board. Inside the box was a clear baggie with a green leafy substance. The baggie later field tested positive for marijuana and weighed approximately 9.14 grams. There was rolling paper and scissors used for cutting marijuana inside the box. I read HOLMES Implied Consent and he agreed to take the State's Test. HOLMES then asked me what the penalty was if he did not take the State's Test. I advised HOLMES, whether or not he takes the State's test, his license will be suspended. While continuing to speak to HOLMES and re-reading him the State's Test, HOLMES commented that a blood test would show that there is marijuana in his system. Holmes stated he no longer wanted to take the State's Test. I completed an Officer's Affidavit and Notice of Revocation/Disqualification. HOLMES was provided a copy and given a temporary license.
I conducted an Inventory and Stored Vehicle Report. KAPS Towing was contacted and they arrived and took possession of the vehicle.
I transported HOLMES to the Creek County Justice Center for incarceration. HOLMES will be charged with Ct. 1: DUI – Drugs, Ct. 2: Possession of Marijuana, Ct. 3: Unlawful Possession of Paraphernalia, Ct. 4: No Seat belt, Ct. 5: Failure to Signal While
