Construction manager agency means a fee based service in which CM is responsible exclusively to the owner, acts in the owner’s interests throughout each stage of the project and does not contract with subcontractors. It offers advice on optimum use of available funds; project scheduling; control of the scope of the work; avoidance of delays, changes, and disputes; optimum flexibility in contracting; and procurement.
Construction manager at risk is a delivery method on which CM is committed to deliver the project within a fixed time and budget (Guaranteed Maximum Price) which are based on the construction documents and specifications at the time of the GMP …show more content…
The clause 3.14.1 indicates that the school district or the construction manager can make changes in any of the services required under this contract. But it clearly states that any delays of construction schedule and even increased construction value due to change orders shall not increase construction managers fees. I completely disagree with this clause because CM gets his fees to manage and execute everything and by any reason there is a delay in construction because of school district then he needs to get extra payment for the same. As in commercial industry, every person gets overtime payment then why CM should not get an extra payment for his …show more content…
The clause 9.1 (a)(c)(d) states Indemnification which says that CM should fully defend, save, protect, indemnify and hold harmless to school district for all damages, losses, claims, suits, actions and expenses. I completely disagree with this clause because CM is appointed to get work done on time and on budget, if he gets involved to defend and compensates school district for claims or files of lawsuit then when he would execute the contract on given time schedule. There needs to be responsible person for school district who deals with such claims and lawsuit. If the clause would be to save, protect, defend the assigned contract, then CM should surely get involve for the claims and reports as he was appointed for the
